NNT, LLC("us" or "we" or "our") owns and operates the ndapp.org ("Site") and the GasBot Discord Bot ("GasBot"). The following Terms of Use (“TOU”) govern your use of the Site and GasBot. Other sites or content owned or controlled by us may have their own terms and should be reviewed. You agree that by accessing GasBot or the Site, that you have read, understood, and agree to be bound by all of these TOU.

IF YOU DISAGREE WITH ANY PART OF THESE TOU, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING GASBOT AND/OR THE SITE, AND YOU MUST IMMEDIATELY CEASE USE. We may also offer promotions, sweepstakes, contests, services, or features that have their own terms of use or rules, and to the extent any portion of those special terms conflict with these TOU, the special terms will govern for that specific portion. We reserve the right, in our sole discretion, to make changes or modifications to these TOU from time to time. We will alert you about any changes by updating the “Last Updated” date of these TOU, and you waive any right to receive specific notice of each such change. Please ensure that you check the applicable Terms every time you use GasBot so that you understand which Terms apply. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of GasBot after the date such revised TOU are posted. GasBot is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access GasBot and/or the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable. These TOU govern:

use of GasBot;
the Site, including its subdomains and any other website or platform application through which we make GasBot available;
applications for mobile, tablet and other smart device systems;
Application Program Interfaces (API); and,
any other related agreement or legal relationship with us in a legally binding way.

I. GASBOT GasBot was created in response to a request from a Neo community member for a GAS tipping service using tokens or digital assets (“Tokens”). Currently, Discord is the main supported platform. The Site contains links to different Discord servers that utilize GasBot. Over time, we hope to expand the number of supported social platforms and increase the range of functionality that the bot can provide to the Neo ecosystem. Neither we or GasBot are affiliated with Discord. The GAS tipping service aligns closely with the motivations driving the GasBot project—activating new users of the Neo ecosystem and encouraging a sharing culture that rewards contributors for their efforts. With GasBot, anyone can become a full-fledged Neo blockchain user, whether as a result of a small act of charity or as a symbol of appreciation for helpful information which the tipper found beneficial. We reserve the right to determine which Tokens are supported by GasBot. Please be aware that GasBot does not support all Tokens. By using GasBot, you acknowledge that we are not liable for any loss of Tokens resulting from theft, loss, mishandling of private keys or any errors or omissions.

II. USER REPRESENTATIONS By using GasBot, you represent and warrant that: (1) you have the legal capacity and you agree to comply with these TOU; (2) you are not under the age of 18; (3) you are not a minor in the jurisdiction in which you reside, or if a minor, you have received parental permission to use GasBot; (4) you will not access GasBot through automated or non-human means, whether through a bot, script or otherwise; (5) you will not use GasBot for any illegal or unauthorized purpose; and (6) your use of GasBot will not violate any applicable law or regulation. You agree that you will only use GasBot, or data/information provided by it, for its intended purposes, and not for other commercial ventures without first seeking approval from GasBot. If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of GasBot (or any portion thereof). By using GasBot, you may need to interact with other GasBot users. You are solely responsible for any such interaction and agree to do so in a manner that is legal, respectable, and consistent with these TOU. GasBot is not responsible for the conduct of any other user who may interact with you, regardless of whether or not it is done through GasBot or through GasBot’s own Discord channel.

III. INTELLECTUAL PROPERTY; LICENSE All content on the Site is the property of GasBot, including, but not limited to, all marks, logos, names, text, data, documents, messages, pictures, images, video, audio, graphics, links, software and its underlying code, domain name, or other electronic files (referred hereafter as “Content”) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and various other intellectual property rights and unfair competition laws of the United States, international copyright laws, and international conventions. Any Content protected by intellectual property laws may not be copied, republished, posted, modified, edited, transmitted, distributed, used to create derivative works of, or reverse engineered without permission, except that you may print out one copy of each Site page solely for noncommercial personal or educational use. No right, title, or interest in any Content is transferred to you as a result of you accessing, downloading, or printing such content from the Site. Any use of Content must display the appropriate copyright, trademark, and other proprietary notices. The Content and the Marks are provided on GasBot “AS IS” for your information and personal use only. Except as expressly provided in these TOU, no part of GasBot and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission. GasBot hereby grants you a revocable and nonexclusive right and license to use the Service (including any underlying software) and GasBot in a manner that is consistent with the other terms in these TOU and GasBot’s intended purposes. GasBot reserves the right to terminate this License for any or no reason and at any time without notice to you, including, but not limited to, for breach of any term contained in these TOU. We reserve all rights not expressly granted to you in and to GasBot, the Content and the Marks. You acknowledge that you have no right, title, or interest in or to GasBot and/or GasBot Content. GasBot and the GasBot logo are marks of GasBot. Other marks, names, and logos on the Site are the property of their respective owners. There may be other content located on the Site not owned by GasBot, and you should respect those property rights as well. All rights not expressly granted herein are reserved to GasBot.

IV. LINKS TO THIRD PARTY SITES AND OTHER SITE INTERACTIONS Our Site may have links to external sites that we don't control or have any affiliation with. We provide these links for your convenience, but we're not responsible for the content on those sites, or those tokens. You visit and/or use them at your own risk. We are not responsible or liable for any loss or damage of any sort incurred as a result of any such dealings and your use of third party sites or tokens. The links we display don't mean we guarantee, approve, recommend, or endorse the linked websites, tokens or any information, content, or products/services they offer. The links don't indicate any association with us. We're not responsible for the linked websites, tokens or any errors or inaccuracies in the information they provide. If you visit the linked websites, you need to follow their terms of use, privacy policies, and other rules. You use the linked websites and tokens at your own risk and should check their policies. We may also let you interact with third-party websites and social media platforms, like Discord, through buttons or plugins. These interactions may allow you to share content with others. Before using these third-party websites, make sure you're comfortable with how your information will be shared. We have no control over these websites, and you use their interaction functions at your own risk. We're not responsible for any harm that may result from using these functions. Our website may show advertisements from third parties. If you click on these advertisements, you'll leave our website, and we're not responsible for the content on the linked websites. V. PROHIBITED CONDUCT In connection with your access and/or use of GasBot, you agree not to:

Trick, defraud, or mislead us and other users, especially in any attempt to learn sensitive account information such as user passwords.
Circumvent, disable, or otherwise interfere with security-related features of GasBot, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of GasBot and/or the Content contained therein.
Disparage, tarnish, or otherwise harm, in our opinion, us and/or GasBot
Use any information obtained from GasBot in order to harass, abuse, or harm another person.
Make improper use of our support services or submit false reports of abuse or misconduct.
Engage in unauthorized framing of or linking to the website.
Violate any federal, state, or local laws or regulations.
Engage in any behavior that is designed to hack into or gain unauthorized access to protected areas of the Site and/or GasBot’s computers, servers or networks, and/or any computers or systems used by other users of the Site.
Make unauthorized attempts to modify any information stored on the Site.
Make attempts to defeat or circumvent security features, or to utilize the Site for any other purpose other than its intended purposes.
Discuss, incite, or promote illegal activity.
Upload/post any unsolicited or unauthorized advertising, promotional materials, spam emails, chain letters, pyramid schemes, or any other form of such solicitations.
Provide false or misleading information when signing up for a Site account or otherwise upload/post any false or misleading information or content through the Site.
Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of GasBot or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of GasBot.
Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.
Delete the copyright or other proprietary rights notice from any Content.
Attempt to impersonate another user or person or use the username of another user.
Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, including without limitation, clear graphics interchange formats (“gifs”), 1×1 pixels, web bugs, cookies, or other similar devices (sometimes referred to as “spyware” or “passive collection mechanisms” or “pcms”).
Interfere with, disrupt, or create an undue burden on GasBot or the networks or services connected to GasBot.
Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of GasBot to you.
Attempt to bypass any measures of GasBot designed to prevent or restrict access to GasBot, or any portion of GasBot.
Copy or adapt GasBot’s software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.
Except as permitted by applicable law, decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of GasBot.
Except as may be the result of standard search engine or Internet browser usage, use, launch, develop, or distribute any automated system, including without limitation, any spider, robot, cheat utility, scraper, or offline reader that accesses the website, or using or launching any unauthorized script or other software.
Make any unauthorized use of GasBot, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.
Use GasBot as part of any effort to compete with us or otherwise use GasBot and/or the Content for any revenue-generating endeavor or commercial enterprise.
Use any type of unauthorized automation within Discord.

The previous list of prohibitions is not exclusive. We reserve the right to terminate your access to the Site or GasBot for any reason. By accepting these TOU, you waive and hold harmless GasBot from any claims resulting from any action taken by us during or as a result of our investigation and/or from any actions taken as a consequence of investigations by either us or law enforcement related to your use of the Site.

VI. REMOVAL OF DATA Manual removal of the data can be requested through email at ndapp@neonewstoday.com. For security reasons we will ask you to provide us with proof of ownership of the server, that you wish the data to be removed of. Only a server owner may request manual removal of data and requesting it will result in GasBot being removed from the server, if still present on it.

VII. CONTRIBUTION LICENSE You agree that we may access, store, process, and use any information and personal data that you provide following the terms of our Privacy Policy and your choices (including settings). By submitting suggestions or other feedback regarding GasBot, you agree that we can use and share such feedback for any purpose without compensation to you. We do not assert any ownership over your Contributions. You retain full ownership of all of your Contributions and any intellectual property rights or other proprietary rights associated with your Contributions. We are not liable for any statements or representations in your Contributions provided by you in any area on GasBot. You are solely responsible for your Contributions to GasBot and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your Contributions.

VIII. SUBMISSIONS You acknowledge and agree that any questions, comments, suggestions, ideas, feedback, or other information regarding GasBot ("Submissions") provided by you to us are non-confidential and shall become our sole property. We shall own exclusive rights, including all intellectual property rights, and shall be entitled to the unrestricted use and dissemination of these Submissions for any lawful purpose, commercial or otherwise, without acknowledgment or compensation to you. You hereby waive all moral rights to any such Submissions, and you hereby warrant that any such Submissions are original with you or that you have the right to submit such Submissions. You agree there shall be no recourse against us for any alleged or actual infringement or misappropriation of any proprietary right in your Submissions.

IX. GASBOT MANAGEMENT We reserve the right, but not the obligation, to: (1) monitor GasBot for violations of these TOU; (2) take appropriate legal action against anyone who, in our sole discretion, violates the law or these TOU, including without limitation, reporting such user to law enforcement authorities; (3) in our sole discretion and without limitation, refuse, restrict access to, limit the availability of, or disable (to the extent technologically feasible) any of your Contributions or any portion thereof; (4) in our sole discretion and without limitation, notice, or liability, to remove from GasBot or otherwise disable all files and content that are excessive in size or are in any way burdensome to our systems; and (5) otherwise manage GasBot in a manner designed to protect our rights and property and to facilitate the proper functioning of GasBot.

X. INDEMNITY You agree to indemnify, defend and hold harmless us, including our subsidiaries and affiliates, and all of our respective officers, directors, employees, affiliates, agents, licensors, representatives, attorneys, and business partners (“Indemnified Parties”), from and against any and all claims, demands, losses, costs, damages, liabilities, judgments, awards, and expenses (including attorneys’ fees, costs of defense, and direct, indirect, punitive, special, individual, consequential, or exemplary damages) we or any of the Indemnified Parties suffer in relation to, arising from, or for the purpose of avoiding, any claim or demand from a third party that relates to or arising out of your: (1) use of GasBot; (2) breach of these TOU; (3) any breach of your representations and warranties set forth in these TOU; (4) your violation of the rights of a third party, including but not limited to intellectual property rights; or (5) any harmful act toward any other user of GasBot with whom you connected via GasBot; (6)the use of GasBot by any person using your password, or (7) or any violation of an applicable law or regulation by you. Your indemnification obligation shall survive the termination of these TOU. Notwithstanding the foregoing, we reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate, at your expense, with our defense of such claims. We will use reasonable efforts to notify you of any such claim, action, or proceeding which is subject to this indemnification upon becoming aware of it.

XI. DISCLAIMER OF WARRANTIES YOUR USE OF GASBOT IS AT YOUR OWN RISK. WE MAKE NO EXPRESS OR IMPLIED WARRANTIES, REPRESENTATIONS OR ENDORSEMENTS WHATSOEVER WITH RESPECT TO THE SITE, GASBOT OR ANY GOODS OR SERVICES OFFERED ON OR THROUGH THE SITE OR GASBOT. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, (EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE), INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, SECURITY, COMPLETENESS, TIMELINESS, APPROPRIATENESS, ACCURACY, FITNESS FOR A PARTICULAR PURPOSE, FREEDOM FROM COMPUTER VIRUSES, TITLE, AND NON-INFRINGEMENT. THE DISCLAIMER OF WARRANTIES APPLIES TO THE SITE, GASBOT, ITS CONTENT, AND ANY GOODS OR SERVICES OFFERED ON OR THROUGH THE SITE OR GASBOT. WE DO NOT WARRANT THAT GASBOT WILL BE UNINTERRUPTED, TIMELY, OR SECURE. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF GASBOT. WE DO NOT WARRANT THAT GASBOT WILL BE ERROR-FREE, THAT ANY ERRORS ON GASBOT WILL BE CORRECTED, OR THAT THE SITE/SERVERS OR GASBOT ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. THE SITE, GASBOT AND RELATED CONTENT, INCLUDING ANY GOODS, SERVICES OR INFORMATION PROVIDED ON OR THROUGH THE SITE OR GASBOT, ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. YOU ASSUME THE ENTIRE COST OF ALL NECESSARY REPAIRS IN THE EVENT YOU EXPERIENCE ANY LOSS OR DAMAGE ARISING FROM THE USE OF THE SITE, GASBOT OR ANY SITE GOODS OR SERVICES. WE MAKE NO WARRANTIES THAT YOUR USE OF GASBOT WILL NOT INFRINGE THE RIGHTS OF OTHERS AND ASSUMES NO LIABILITY FOR SUCH INFRINGEMENT. Digital assets, including DeFi tokens, lack clear regulation. Ongoing and future regulatory actions may alter, perhaps to a materially adverse extent, the Tokens supported by GasBot. If any Token is determined to be a “security” under U.S. federal or state securities laws, GasBot may choose to stop supporting such Tokens.

XII. LIMITATION OF LIABILITY IN NO EVENT WILL WE OR OUR OFFICERS, DIRECTORS, EMPLOYEES, SERVICE PROVIDERS, CONTRACTORS, VENDORS, AFFILIATES, AGENTS, LICENSORS, REPRESENTATIVES, ATTORNEYS, AND BUSINESS PARTNERS BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO, ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, PUNITIVE, ACTUAL, OR OTHER INDIRECT DAMAGES, WHETHER IN CONTRACT OR IN TORT, INCLUDING NEGLIGENCE, OR OTHERWISE, INCLUDING LOSS OF REVENUE OR INCOME, LOST DATA, LOSS OF GOODWILL, PAIN AND SUFFERING, EMOTIONAL DISTRESS, OR SIMILAR DAMAGES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, ARISING OUT OF:

THE USE OR INABILITY TO USE THE SITE, GASBOT OR ANY SITE GOODS OR SERVICES;
ANY TRANSACTION CONDUCTED THROUGH OR FACILITATED THROUGH GASBOT OR SITE;
ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS, OR INACCURACIES THROUGH GASBOT OR THE SITE;
ANY OTHER MATTER RELATING TO THE SITE, GASBOT OR ANY GOOD OR SERVICE OFFERED ON OR THROUGH THE SITE; AND,
ANY LINKS TO THIRD PARTY WEBSITES OR THIRD PARTY CONTENT.

IN NO EVENT WILL THE COLLECTIVE LIABILITY OF US OR OUR OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, LICENSORS, REPRESENTATIVES, ATTORNEYS, AND BUSINESS PARTNERS TO ANY PARTY, REGARDLESS OF THE TYPE OF ACTION WHETHER IN CONTRACT, TORT, OR OTHERWISE, EXCEED THE GREATER OF $100.00 OR THE AMOUNT YOU PAID TO GASBOT FOR THE APPLICABLE GOOD OR SERVICE OUT OF WHICH THE LIABILITY AROSE. IF YOU ARE DISSATISFIED WITH THESE TOU, THE SITE, GASBOT OR ANY GOOD OR SERVICE OFFERED ON OR THROUGH THE SITE OR GASBOT, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE. GIVEN THAT SOME STATES DO NOT ALLOW FOR THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU. THE LIMITATION OF LIABILITY WILL APPLY TO THE GREATEST EXTENT ALLOWED UNDER THE LAW.

XIII. GEOGRAPHIC LIMITATION GasBot operates the Site from its headquarters in the United States, and the Site and TOU are intended only for users within the United States. If you use the Site outside the United States, you are responsible for following your applicable local laws and determining, among other things, whether your use of the Site violates any of those local laws. By using the Site, you agree and acknowledge that information about you, including personally identifiable information, may be transmitted to and stored in the United States.

XIV. PRIVACY POLICY Your use of the Site and GasBot are governed by our Privacy Policy which is incorporated by reference into these TOU. Please review our Privacy Policy: Privacy Policy By using GasBot, you agree to be bound by our Privacy Policy, which is incorporated into these TOU. Please be advised GasBot is hosted in the United States. If you access GasBot from any other region of the world with laws or other requirements governing personal data collection, use, or disclosure that differ from applicable laws in [INSERT], then through your continued use of GasBot, you are transferring your data to [INSERT], and you agree to have your data transferred to and processed in [INSERT]. Further, we do not knowingly accept, request, or solicit information from children or knowingly market to children. Therefore, in accordance with the U.S. Children’s Online Privacy Protection Act, if we receive actual knowledge that anyone under the age of 13 has provided personal information to us without the requisite and verifiable parental consent, we will delete that information from GasBot as quickly as is reasonably practical. If you are a resident of the European Union, United Kingdom, Lichtenstein, Norway, or Iceland, you may have additional rights under the EU General Data Protection Regulation (the “GDPR”) with respect to your Personal Data.

XV. MISCELLANEOUS Any and all disputes relating to these TOU, the Site, GasBot and/or any goods or services offered on or through the Site, are governed by, and will be interpreted in accordance with, the laws of State of Wyoming, without regard to any conflict of laws provisions. You hereby irrevocably and unconditionally consent to submit to the exclusive jurisdiction of the courts of the State of Wyoming for any litigation arising out of or relating to the use of the Site or GasBot, waive any objection to the venue of any such litigation in the State of Wyoming courts, and agree not to plead or claim in any State of Wyoming court that such litigation brought therein has been brought in an inconvenient forum. If any provision or part of a provision of these TOU is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these TOU and does not affect the validity and enforceability of any remaining provisions. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these TOU or use of GasBot. You agree that these TOU will not be construed against us by virtue of having drafted them. You hereby waive any and all defenses you may have based on the electronic form of these TOU and the lack of signing by the parties hereto to execute these TOU. These TOU constitute the entire agreement of the parties with respect to GasBot and supersede all prior communications, promises and proposals, whether oral, written, or electronic, between you and us, with respect to GasBot. Our failure to enforce any portion of these TOU is not a waiver of such portion. The proprietary rights, disclaimer of warranties, representations made by you, indemnities, and limitations of liability shall survive the termination of these TOU. We reserve the right, without notice and reason, to take down or terminate the Site or otherwise revoke any and all access granted to you related to GasBot. You agree that we are not liable to you or any other third party for this action. We do not assume any liability or responsibility for your use of the Internet or the Site including, but not limited to, any change your computer or related systems may sustain as a result of accessing the Site. Certain software elements of the Site and related to GasBot services may be subject to U.S. export laws and controls. As such, no software may be downloaded or exported to any country or foreign citizen that is under a U.S. embargo or that would otherwise violate U.S. law or regulations.

XVI. ELECTRONIC COMMUNICATIONS, TRANSACTIONS AND SIGNATURES Using GasBot, visiting the Site, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically, via email and on GasBot, satisfy any legal requirement that such communication be in writing. YOU HEREBY AGREE TO THE USE OF ELECTRONIC SIGNATURES, CONTRACTS, ORDERS, AND OTHER RECORDS, AND TO ELECTRONIC DELIVERY OF NOTICES, POLICIES, AND RECORDS OF TRANSACTIONS INITIATED OR COMPLETED BY US OR VIA GASBOT. You hereby waive any rights or requirements under any statutes, regulations, rules, ordinances, or other laws in any jurisdiction which require an original signature or delivery or retention of non-electronic records, or to payments or the granting of credits by any means other than electronic means.

XVII.
